TINJAUAN YURIDIS TERHADAP TINDAK PIDANA TURUT SERTA DALAM PERKARA PENADAHAN PUPUK (Studi Putusan Nomor 91/Pid.B/2025/PN Tjk)

Abstract

This study analyzes the application of criminal law to the crime of receiving subsidized fertilizer, as outlined in Decision Number 91/Pid.B/2025/PN TJK, involving defendant Sumiran bin Kamsiah. Using a normative and empirical juridical approach, this study reveals that economic factors, unreasonable prices, and the presence of opportunity are the primary drivers of the perpetrator's receiving of embezzled goods. The results indicate that the judge's considerations focused on the evidentiary strength of the "knowledge" or "reasonable suspicion" element of the goods' origin. This study concludes the importance of law enforcement officers' thoroughness in gathering evidence and public caution in transactions. It is hoped that these results will contribute to the development of criminal law in Indonesia, particularly in addressing the complexity of receiving cases.   Keywords: Receiving Stolen Property; Criminal Law; Fertilizer; Court Decision.
