EFEKTIVITAS ARBITRASE DALAM MENGATASI SENGKETA MEDIS : TINJAUAN HUKUM DAN PSIKOLOGIS

Meningkatnya kompleksitas pelayanan kesehatan modern telah memunculkan dinamika baru dalam hubungan dokter-pasien yang berpotensi menimbulkan sengketa medis. Penelitian ini bertujuan menganalisis efektivitas arbitrase sebagai mekanisme alternatif penyelesaian sengketa medis melalui perspektif interdisipliner antara ilmu hukum dan psikologi. Metode penelitian menggunakan pendekatan normatif yuridis dengan teknik tinjauan pustaka terhadap regulasi terkait dan literatur akademik yang relevan. Hasil penelitian menunjukkan bahwa arbitrase medis memiliki tingkat efektivitas yang signifikan dengan durasi penyelesaian rata-rata 3 bulan dibandingkan litigasi konvensional yang memerlukan 1-2 tahun. Faktor demografis dan psikologis mempengaruhi persepsi efektivitas proses, dimana mediator berlatar belakang hukum mencapai skor kepuasan tertinggi (3,84) dibandingkan mediator medis (3,74) dan administratif (3,63). Kerangka hukum Indonesia melalui UU No. 30 Tahun 1999 dan UU No. 17 Tahun 2023 memberikan landasan yuridis yang memadai bagi implementasi arbitrase medis. Integrasi aspek psikologis dalam proses arbitrase melalui teknik komunikasi terapeutik dan manajemen emosi terbukti meningkatkan kepuasan para pihak. Penelitian menyimpulkan bahwa arbitrase medis merupakan alternatif efektif dalam penyelesaian sengketa kesehatan yang dapat mengakomodasi kebutuhan yuridis dan psikologis para pihak secara simultan.References
