MAHKAMAH KONSTITUSI, MAHKAMAH AGUNG DAN UNDANG-UNDANG NOMOR 10 TAHUN 2004 TERHADAP HAK MENGUJI UNDANG-UNDANG

Abstract

Sejak Indonesia merdeka sampai saat ini, kinerja hukum dan penegak hukum masih dianggap kurang memenuhi harapan dan perasaan keadilan masyarakat. Lembaga peradilan yang seharusnya menjadi benteng terakhir (last forttress) untuk mendapatkan keadilan sering tidak mampu memberikan keadilan yang didambakan. Akibatnya, rasa hormat dan kepercayaan terhadap lembaga ini nyaris tidak ada lagi sehingga semaksimal mungkin orang tidak menyerahkan persoalan hukum ke pengadilan. Pendapat Laurence M. Friedman sangat menggambarkan kondisi Indonesia saat ini. Konsekuensi suatu aturan perundang-undangan tidak mengikuti dan memiliki asas-asas tersebut dalam UU No. 10 Tahun 2004, maka akan terjadilah ketidakadilan terhadap masyarakat. Artinya tujuan keadilan dari hukum tidak terpenuhi. Selain itu produk hukum tersebut akan banyak dimohonkan pengajuan pengujian materi produk hukum itu. Indonesia menganut sistem pengujian materil terbatas bagi Mahkamah Agung, yakni terbatas pada pengujian materil (‘materieele toetsing’) terhadap peraturan perundang-undangan di bawah undang-undang. Hakim juga dapat menguji Keputusan Tata Usaha Negara (K.TUN) yang memuat pengaturan yang bersifat umum (‘besluit van algemene strekking’). Mahkamah Agung hanya boleh menguji formal (‘formele toetsing’) terhadap undang-undang namun tidak boleh menguji substansi (materi) undang-undang. Mahkamah Agung tidak memiliki hak menguji materi (‘materieele toetsingsrecht’) terhadap undang-undang. Pengujian materil terhadap peraturan perundang-undangan di bawah undang-undang dipandang kurang efektif karena kaidah hukum yang paling efektif Kata Kunci: Mahkamah Konstitusi, Mahkamah Agung, Undang-Undang Abstract Since Indonesia's independence until now, the performance of law and law enforcement is still considered to be inadequate in fulfilling the hopes and feelings of justice for the people. Judiciary institutions that are supposed to be the last fortress to obtain justice are often unable to provide the desired justice. As a result, respect and trust in this institution is almost non-existent so as much as possible people do not submit legal issues to the court. Laurence M. Friedman's opinion is very describing the current condition of Indonesia. The consequences of a statutory regulation do not follow and have these principles in Law No. 10 of 2004, there will be injustice against the community. This means that the purpose of justice from the law is not fulfilled. In addition, these legal products will be requested for submission of testing materials for legal products. Indonesia has a limited material testing system for the Supreme Court, which is limited to material testing (pengujian materieele toetsing ’) of statutory regulations under the law. The judge can also examine the State Administrative Decree (K.TUN) which contains a general regulation (‘besluit van algemene strekking’). The Supreme Court may only examine the formal (‘formele toetsing’) of the law but may not examine the substance of the law. The Supreme Court has no right to examine the material (‘materieele toetsingsrecht’) of the law.
